'Blurred Lines' lawyer confirms appeals will follow
A hot contender for least surprising development of the year, Robin Thicke and Pharrell Williams' legal man Howard King has told Fox he will appeal last week's controversial ruling in which a jury decided the terrible twosome had lifted elements of Marvin Gaye's 'Got To Give It Up' for their hit 'Blurred Lines'.

As previously reported, Thicke and Williams were ordered to pay over $7.3 million to the Gaye family in damages, and lawyers for the latter are now pushing to have distribution of 'Lines' stopped until a deal can be done on future royalties.

Many have mused on what precedent the ruling sets, given the argument presented by King in court that any elements 'Got To Give It Up' and 'Blurred Lines' have in common are just common elements of pop music in general, and can be found in many songs.

Some reckon that makes this a dangerous ruling that will impact on the art of pop-making if it is allowed to stand, though it's true that pursuing copyright infringement litigation of this kind remains risky and expensive, meaning it is only really viable to go fully legal if the rip off record is worth a lot of money, and few hits from the last ten years have been as lucrative as 'Blurred Lines'.

But nevertheless, King says that "we owe it to songwriters around the world to make sure this verdict doesn't stand". Speaking to Fox Business News, he went on: "My clients know that they wrote the song 'Blurred Lines' from their hearts and souls and no other source. We are going to exercise every post trial remedy we have to make sure this verdict does not stand. We look at it as being in the seventh inning of a game that could go into extra innings".

That's a baseball reference there, by the way. I'd explain it, but I bet you'd rather read a fabric-based simile for the 'Blurred Lines' case wouldn't you? And King has one of them too.

"If this is the way the law is going to go", he said of last week's ruling. "Then the creator of rayon better look behind him for lawsuits from the owners of silk, because, even though they feel the same they are structurally, completely different, just like these songs".

DJ Neil Fox faces more sex assault allegations
Radio DJ Neil Fox was last week arrested for a third time over allegations he sexually assaulted a woman, this time in the early 1990s.

Fox, then working for radio station Magic, was first arrested last September after two women accused him of a total of four sexual assaults. A second arrest followed in December over three further allegations. Most of the allegations made so far, like the latest, seemingly involve 'historical' incidents, though one is thought to relate to an assault that allegedly took place last year.

On Friday, Fox was formally arrested after voluntarily attending a central London police station to face questioning over the new allegations. He was subsequently bailed.

The DJ has been off the airwaves since his first arrest, though he has previously denied all the claims made against him.

Spears family lawsuit with alleged former manager to return to court
The many and varied dramas of Britney Spears back in 2007 and 2008 all seem so long ago now, but one hangover from the 'dark times' is set to be revived in the court room.

Those with long memories will remember Sam Lutfi, the guy who became a very close friend of Spears as her personal life spiralled out of control, and who later styled himself as the singer's manager. But after her family, and the state, intervened amongst growing concerns about Spears' mental wellbeing, Lutfi was pushed out of the picture.

He subsequently sued the family. Lutfi claimed he had been defamed by Spears' mother in a book about her daughter's struggles. She accused Lutfi of exasperating Britney's problems and drug taking, whereas he claimed that he had actually pressured the singer to deal with her addictions. There were also allegations that Spears' father assaulted Lutfi, while the latter claimed that he had, for a time, been Britney's manager and was therefore due a cut of her income from that period.

The case reached court in 2012, with both Lutfi and Mrs Spears taking to the witness stand, but two weeks in the judge overseeing the proceedings called everything off, citing various weaknesses in Lutfi's arguments and inconsistencies in his testimony.

That decision basically killed off the defamation part of the case, but the breach of contract element has rumbled on, and last week appeal judges in California said that the dispute should be considered anew by a jury

Noting the inconsistencies that had occurred when Lutfi tried to explain his contractual relationship with Spears, judge Victoria Chavez said, according to Billboard: "We must determine whether Sam's inconsistent testimony as to the start date, the right to terminate, and calculation of his fees shows insufficient clarity of material terms to enforce the alleged contract as a matter of law. We find that it does not. As set forth above, it is a factual question for the jury to determine whether an oral contract was formed between Sam and Britney, and if so, to interpret the material terms of that contract".

All of which means the contractual bit of Lutfi's litigation - and the assault allegation against Mr Spears - will now return to court for a second hearing proper.

MPG backs BASCA's digital pie campaign
The Music Producers Guild is backing the songwriting community in its bid to get a bigger slice of the monies generated by streaming music services.

As previously reported, the 'digital pie' debate has increased in volume in recent months, with artists, songwriters and some music publishers reckoning that record companies are getting a disproportionate share of the monies paid into the music community by streaming music services.

The digital splits between the different stakeholders in music copyright are very much based on the way money is divvied up when a CD is sold. Artists, songwriters and publishers may see a percent or two more of streaming income than they do from physical music product, but in the main the lion's share of the loot ends up with the label.

Record companies argue that they spend the most money producing, distributing and marketing recorded music, and are still the primary risk takers when it comes to new talent, and that they need their big cut of the resulting streaming income to justify those investments. They also insist that if everyone would just wait for streaming to go truly mainstream, each party's respective cut of the 'pie' would be sufficiently sized to keep everyone properly nourished.

But some key artists, songwriters and publishers say that - while it may be true labels are still the primary investors in new talent and content - the labels' risks are less in digital than they are in physical. Others argue that streaming is more like radio than CD, and in broadcast royalties are traditionally split pretty much four ways between labels, artists, publishers and songwriters.

As previously reported, the British Association Of Songwriters, Composers And Authors weighed into this debate earlier this year with its The Day The Music Died campaign, arguing that the current set-up is simply unsustainable for any songwriter who isn't also a featured artist.

And this weekend the Music Producers Guild came out in support of that campaign. MPG Director Mick Glossop told reporters: "We feel it is important for the MPG to back this campaign because songwriters, along with record producers, are suffering as a result of the vastly diminished income from sales of recorded music, and we believe that changes are needed in order to re-balance the income streams".

In the US, where songwriters and publishers are also getting vocal about digital royalties, much of the battle is taking place in Congress and the courtroom, because the publishing side of the business is constrained by compulsory licenses and inflexible collective licensing rules, both of which the songs industry is trying to alter.

But in the Europe, where the current royalties framework is less the result of statutory intervention, it's less clear where to take the fight. And that's topic we'll be tackling during CMU Insights @ The Great Escape this May - watch this space!

Jez Bell moving to PPL, sparking more Rara chatter
Jez Bell is returning to the collective licensing domain by joining the UK record industry's performing rights organisation PPL as Chief Licensing Officer. Bell was previously Director Of Broadcast And Online for the music publishing sector's PRO, PRS For Music, though in more recent years he has been working for digital platform provider Omnifone, and its sister company Rara.

At PPL, Bell takes over from Tony Clark, the society's Director Of Licensing, who is retiring after fourteen years with the music rights body. Paying tribute to Clark, who worked within major labels before joining PPL, the society's boss Peter Leathem said: "Tony has been a key contributor to PPL's growth. I, along with everyone in the company, wish Tony a very happy and fulfilling retirement".

Bell's imminent move to PPL has led to more chatter about Rara, the streaming service which he led for a time as CEO, after moving over from Omnifone.

As previously reported, the boss of the latter, Jeff Hughes, recently told Music Ally that Omnifone had taken Rara back under its wing, having previously spun it off as a separate entity, but was now looking to offload the platform. And last week he confirmed to Music Business Worldwide that Rara was not currently taking on new subscribers, adding that the set-up would be wound down if a buyer can't be found.

Indies release 'anti-Record Store Day' record
With Record Store Day zooming into view, just there, on that horizon we all know and love, it's surely time for some detractors to the indie-record-store-celebrating party to step forward. And doing the honours this year are indie labels Sonic Cathedral and Howling Owl.

Though it's not an especially brutal assault, more an open musing about what Record Store Day has become. And some commentary on the well known problem for indie labels at this time of year, getting time on a vinyl press so that you can have your Record Store Day special releases, or any records for that matter, on sale on time.

The two labels issued a statement as they announced a non-Record Store Day release, which will see Spectres and Lorelle Meets The Obsolete cover each other's songs on a limited edition release that will be released one copy a day over the next year.

Say the labels: "We are releasing one copy a day for a whole year via selected shops and recordstoredayisdying.com to make some sort of point about how every day should be record store day, and because it seemed like an amusing, foolhardy thing to do".

They go on: "Make no mistake, though, this is not a protest against record shops, because we love record shops (some copies of this record will actually be available in them). It's not even really a protest against Record Store Day, which is essentially a good idea, or was when it began in 2007, even if it is far too focused on 'product' rather than the actual shop spaces and their role in the communities they serve".

But, they say, "If it's a protest against anything, it's what Record Store Day has become: just another event in the annual music industry circus that begins with the BBC Sound Of... list and ends with the Mercury Prize, co-opted by major labels and used as another marketing stepping stone".

They then note the big artists and labels putting out releases for Record Store Day, which certainly generate some media hype, but are they really in the spirit of the project? Sonic Cathedral and Howling Owl would say not.

"Because of the rules and regulations - minimum pressing amounts, no direct to customer sales, blah blah blah - Record Store Day really isn't fun, and it's certainly not beneficial to small, backs-to-the-wall labels like Sonic Cathedral and Howling Owl. But we are still affected by it. Badly. There are currently no copies of Spectres' album 'Dying' on vinyl in the shops because the repress is somewhere towards the back of the queue after some Foo Fighters studio scrapings, a host of EPs by The 1975 and about a million heavyweight 'heritage rock' reissues that no one really needs".

They conclude: "The final irony was getting a call to say that this very seven-ich was going to be delayed and might not be shipped until after Record Store Day. We've switched plants, and fingers crossed they will appear on time for the first copy to go on sale on 18 Apr. If they don't, well, there are 364 other days on which to buy and release records..."

MAMA owner considering sale bids
MAMA & Company has appointed advisors to consider offers for the festival and venue business, following a flurry of rumours about the company being sold which have circulated for a couple of months now.

Since being bought out of the HMV Group by then CEO and co-founder Dean James in 2012, MAMA has been owned by Lloyds Development Capital, the private equity arm of Lloyds Bank, which also recently acquired the Birmingham-based arena business the NEC Group.

It's thought that although LDC hasn't been actively shopping MAMA, there are at least two bidders interested in the firm, most likely existing entertainment businesses. And, as a private equity set up, LDC will consider any serious offer.

And all of that certainly comes across in 'Summer Rain', a woozy pop track packed with a feeling of longing. The track's smart production, Steckler cutting up her vocals to dance around the instrumental portions, creates a rich atmosphere to sink back into.

Unlocking The Truth attempting to break Sony Music deal
Teen metal band Unlocking The Truth are in the process of breaking out of the record deal they signed with Sony Music just last year.

As previously reported, the deal was rumoured to be worth almost $2 million to the band, if they managed to record five albums for the major over the life of the contract. However, it now seems that it may come to an end without any releases coming out whatsoever.

"Our attorneys are in the process of us exiting the label", drummer Jared Dawkins told BuzzFeed News ahead of the premiere of a documentary about the band at SXSW. Asked why, he replied: "Just complications".

"We can't discuss the complications", added bassist Alec Atkins. "But complications - that's what I can tell you".

The record deal already required court approval in New York due to the trio's ages - between twelve and thirteen at the time. This and the subsequent tension between the band and both the label and their management is captured in the documentary, which was announced shortly after the deal was signed. The film was directed by Luke Meyer, who previously made a short about the band's street performances in Times Square.

Grimes denies scrapping album due to rejected Rihanna song reaction, premieres new track on Girls
Grimes has denied reports that she scrapped an album's worth of material due to some fans' negative reaction to her 2014 single, 'Go', which was originally written for Rihanna.

In an interview with The New York Times last year, the musician said that she had canned the LP she was working on because "it sucked", though she also commented on the reception 'Go' received, saying: "It upsets a lot of my fans, and I get why it upsets them. Everybody was like, 'Oh, Grimes is pandering to the radio'".

A link between the two was certainly implied in the article, though Grimes says that this was not the case and is annoyed that this story continues to pervade.

"I honestly never ditched an album due to negative fan reaction to 'Go'", she wrote on her Tumblr blog on Friday. "'Go' did really well, in my opinion. Obviously some people didn't like it, as it was different from my other material, but isn't that the point of collaborations / trying to write for other artists? ... The album was scrapped cuz it was depressing and I didn't want to tour it. I may release it one day. This all happened before 'Go' was ever released".

She added that scrapping music isn't an uncommon part of her creative process, continuing: "I throw out music all the time. I have almost 1000 gigs of unreleased music on my hard drive. I just want the next album to be as good as possible. 'Go' was never on the album anyway, it is a collaboration with a close friend that was released for fans as a 'thank you' for waiting since my album was being delayed".

X-Factor' New Zealand sacks judges for bullying
Two judges on New Zealand's version of 'X-Factor', married couple Natalia Kills and Willy Moon, have been sacked for bullying a contestant live on the show on Saturday night. Even though that was basically their job.

Joe Irvine was berated by Kills for 'copying' Moon's look by wearing a suit and having a similar haircut. Even though Irvine presumably didn't actually style himself, she launched into a tirade against the 'X' contender, saying: "We have a doppelganger in out midst. I - as an artist who respects creative integrity and intellectual property - I am disgusted at how much you have copied my husband".

She continued: "From the hair to the suit - do you not have any value or respect for originality? You're a laughing stock. It's cheesy, disgusting [and] I personally found it absolutely artistically atrocious. I am embarrassed to be sitting here in your presence having to even dignify you with an answer of my opinion".

And before anyone could point out that 'X-Factor' is really no place to be talking about artistic integrity, Moon chipped in, saying: "To me it just feels a little bit cheap and absurd. It's like Norman Bates dressing up in his mother's clothing. It's just a little bit creepy and I feel like you're gonna stitch someone's skin to your face and then kill everybody in the audience".

So to conclude, if you see Willy Moon or Natalia Kills around the place, probably best to flatten your hair and take off your suit jacket.

Following the show, its broadcaster TV3's parent company MediaWorks confirmed that Moon and Kills had been fired following the outburst, leaving only two judges - Stan Walker and Melanie Blatt - on the panel for last night's edition.

In a statement, MediaWorks CEO Mark Weldon said: "Last night on 'X-Factor' both Kills and Moon made comments that were completely unacceptable. While the judges on 'X-Factor' are expected to provide critiques of the performances, we will not tolerate such destructive tirades from any of the judges".

He continued: "Contestants put their all into this competition and they should expect to receive feedback and criticism that is professional and constructive. We no longer have confidence that Kills and Moon are the right people to perform the role of 'X-Factor' judges and they will leave the show, effective immediately".

A spokesperson for FremantleMedia, which manages the 'X-Factor' franchise with Syco, said: "We 100% support TV3 and MediaWorks in their decision to remove them. 'The X-Factor' does not tolerate the behaviour they displayed last night".
