Phil Spector's retrial for murder will take place in October, after his defence team's previously reported claims that changes to the charges in the new trial would lead to a 'double jeopardy' situation were rejected.
As previously reported, the legendary producer's lawyers last week requested an indefinite stay on the retrial in order for them to further pursue their double jeopardy claims, which stem from the lesser crimes of voluntary or involuntary manslaughter being added to the charges to be considered at the second trial. However, Superior Court Judge Larry Paul Fidler, who had already previously said he did not think that this amounted to double jeopardy, denied this request and set the date for the new trial.
Spector, of course, is accused of killing actress Lana Clarkson at his Beverly Hills home in 2003. He maintains she shot herself.
