One up for Tony Brummel in his ongoing fight with rockers Hawthorne Heights. As previously reported, Hawthorne Heights are trying to get out of their recording contract with Brummel's indie label Victory Records - claiming that the label had misrepresented them and had failed to pay them royalties. The band sued Victory in order to break away from the label, but Judge Milton Shadur of the US District Court in Chicago dismissed the lawsuit last week, calling the band's claims against the label "absurd". This means that Victory can continue to sell the band's first two albums, and demand the two additional albums they are owed by the current contract. That said, the band say they will continue with their legal fight. A spokesman said last week: "We disagree with Victory's characterization of the Court's ruling, and we remain confident in our claims against Victory and Tony Brummel. We expect to prevail when all is said and done".
